These general terms and conditions apply to all offers, orders, and agreements concluded via FINIQUE's webshop.

Article 2 – Definitions

In these terms and conditions, the following definitions apply:

  • FINIQUE: the seller of sportswear and accessories.
  • Customer: any natural or legal person who places an order.
  • Agreement: any agreement between FINIQUE and the customer.

Article 3 – Applicability

  1. These general terms and conditions apply to all offers, orders, and agreements.
  2. By placing an order, the customer agrees to these terms and conditions.
  3. Deviations are only valid if agreed upon in writing.

Article 4 – Offer

  1. All offers are without obligation.
  2. Obvious errors or mistakes in prices, images, or product descriptions do not bind FINIQUE.
  3. Images are for illustration purposes only. Colors may vary slightly from reality due to screen settings.

Article 5 – Prices

  1. All prices are stated in euros (€).
  2. The stated prices include VAT, unless otherwise indicated.
  3. Shipping costs are clearly stated during checkout.

Article 6 – Orders

  1. An agreement is concluded as soon as FINIQUE has confirmed the order by email.
  2. FINIQUE reserves the right to refuse an order in case of:suspicions of fraud;incorrect data;payment issues;force majeure.

Article 7 – Payment

The customer must pay for the order immediately using one of the offered payment methods.

If a payment is refused or canceled, FINIQUE reserves the right not to process the order.

Article 8 – Delivery

  1. FINIQUE strives to ship orders as quickly as possible.
  2. Stated delivery times are indicative.
  3. Exceeding a delivery time does not entitle the customer to compensation.
  4. The risk of damage or loss passes to the customer as soon as the order has been delivered.

Article 9 – Shipping Costs

The current shipping costs are displayed during checkout.

For promotions offering free shipping, this will be clearly stated.

Article 10 – Right of Withdrawal

Consumers have the right to withdraw their order within 14 days of receipt without giving reasons.

After notification of withdrawal, the customer has another 14 days to return the product.

Article 11 – Return Conditions

Returns will only be accepted if:

  • the product is unworn;
  • the product is unused;
  • labels are still attached;
  • the item is clean;
  • the item does not contain perfume, smoke, make-up, or washing odors;
  • the item is returned in its original packaging.

FINIQUE reserves the right to refuse returns if the above conditions are not met.

Article 12 – Exceptions to Returns

Returns are not possible for:

  • gift vouchers;
  • personalized items;
  • products that cannot be returned for hygiene reasons if the seal has been broken.

Article 13 – Refund

After receipt and inspection of the returned item, the purchase amount will be refunded within 14 days at the latest via the same payment method used for the original purchase.

FINIQUE may wait with the refund until the return shipment has been received.

Article 14 – Warranty

FINIQUE guarantees that the delivered products comply with the agreement and meet reasonable requirements of soundness.

Normal wear and tear, incorrect use, or damage due to improper washing are not covered by the warranty.

Article 15 – Complaints

Complaints must be reported in writing within a reasonable time after discovery via:

FINIQUE aims to respond substantively to complaints within 14 days.

Article 16 – Liability

  1. FINIQUE is only liable for direct damage resulting from intent or gross negligence.
  2. Any liability is limited to a maximum of the purchase amount of the order concerned.
  3. FINIQUE is not liable for indirect damage, consequential damage, or loss of profit.

Article 17 – Force Majeure

FINIQUE is not liable for delays or non-fulfillment of obligations due to force majeure, which includes, but is not limited to:

  • natural disasters;
  • strikes;
  • pandemics;
  • transport problems;
  • disruptions at suppliers;
  • government measures.

Article 18 – Privacy

FINIQUE processes personal data in accordance with applicable privacy legislation (GDPR).

Article 19 – Intellectual Property

All texts, photos, designs, logos, images, and other content on the website are owned by FINIQUE or are used with permission.

None of this may be copied, distributed, or used without written permission.

Article 20 – Applicable Law

All agreements are exclusively governed by Dutch law.

Disputes will be submitted to the competent court in the Netherlands, unless mandatory law dictates otherwise.
